NEST BEDDING TERMS OF SERVICE ("AGREEMENT")

Effective Date of Current Policy: 06-01-2023

Please read these Terms of Service ("Agreement," "Terms of Service") carefully before using www.nestbedding.com ("the Site") operated by Nest Bedding ("us," "we," or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.nestbedding.com.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement.

INTELLECTUAL PROPERTY
The Site and its original content, features, and functionality are owned by Nest Bedding and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.


TERMINATION
We may terminate your access to the Site without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.


CANCELLATIONS

Cancellations. To cancel your Nest Bedding order, we ask that you message our team directly within 24 hours of placing your order. After 24 hours, your order may be in transit and incur additional return charges. To initiate a cancellation, please message us at customerservice@nestbedding.com or by calling your store of purchase.

Early cancellations of shipped/in-transit goods will incur a $100 return-to-sender fee for mattresses and up to a $15 return-to-sender fee for smaller goods. The fee to return will be deducted from the refund of the value of an order once received.



REFUNDS
Once your returned product has been received and verified as undamaged and in the condition it was originally sent, Nest Bedding will approve your refund. The refund is typically processed to your original purchase payment method. However, if your original payment method is no longer valid (e.g., cancelled credit card), we require verification of this cancellation for fraud prevention purposes. Upon receiving such verification, we will offer an alternative refund method, such as a manual refund check. Please allow 5 to 10 business days for the funds to process fully back to your account for standard refunds. The timeframe for alternative refund methods may vary and will be communicated accordingly.


RETURNS
General Returns Information: You may initiate your return request by contacting Nest Bedding through customerservice@nestbedding.com or the Nest Bedding store of purchase. Once approved for return, you have 30 days to complete the process. After 30 days, return privileges are forfeited. If you purchased your Nest Bedding product with a promotional code, the dollar value of that promotional code would not be refunded or credited back if any or all merchandise is returned. If your promotional pricing is based on the total dollar value of your cart and items are returned, lowering the total dollar value of your cart, an adjusted amount shall be returned to your account. All white glove delivery and set-up service fees once concluded with your order, are considered a non-refundable charge and will be excluded from your final refund amount.

Mattress Returns (For purchases after 10/21/2021): Mattresses are eligible for returns for comfort reasons only after the required 30-night adjustment period and within 365 nights of the delivery date of that particular mattress. Refunds will be issued to the original purchase payment method if the original payment method authorization permits. An alternative refund method will be offered if an approved returned sale cannot be refunded to the original payment method. The 365-night trial period is available once per mattress per calendar year from the delivery date and cannot be extended or paused. Mattress returns within the initial 30 nights of trial, which are unpackaged and used, will incur the full disposal cost. To return your Nest Bedding mattress, please email Nest Bedding Customer Service, customerservice@nestbedding.com, or contact the Nest Bedding store of purchase. We will request pictures of your mattress, both sides of the legal tag, and additional information about the base that supports your mattress. Foundations that do not meet the minimum requirements for support will be denied a return until the mattress is used in conjunction with an approved foundation. Using flexible foundations, bowed slat foundations, and traditional box springs will void all return, exchange, and warranty privileges. All slatted foundations must have a maximum of a four-inch gap between each non-flexible slat and must be present to support a mattress and achieve the intended comfort level properly. Once approved for return, Nest Bedding will provide you with a donation, disposal, or pick-up option. Return options vary based on the purchasers’ service area. Mattresses must be in donatable condition to be eligible for return (e.g., no stains, tears, or soiling odors). Once your return is complete, please upload your donation/disposal receipt to Nest Bedding for verification. Please allow 5 to 10 business days for the funds to process fully back to your account if the refund is issued to the original payment method. Alternative refund option timeframes may vary depending on the method of payment.

*Mattresses excluded from 365 Night Sleep Trial: The Puffin mattress (formerly known as the BKB), the Lark mattress, and the Stork mattress (formerly known as the Organic Crib Mattress). These mattresses must be returned within 30 days of receiving the product.

Pillow Returns: All Nest Bedding Pillows carry a 30-night return period. Have you tried removing some of the fill in your pillow? Or you could message us and ask for more fill to be sent to you. You may return your Nest Bedding pillow within 30 days of the product's delivery date. Pillows must be returned in original Nest Bedding packaging. Once approved for return, we will provide a free shipping return label.

Kid’s & Baby Mattress Returns: The Puffin, Lark, and Stork mattresses are not eligible for our 365 Night Comfort Trial. Kid’s and baby mattresses must be returned within 30 days of receiving the item to be eligible for a return.

Bedding Returns (Bedding refers to all Protectors, Sheet Sets, Duvet Covers, Comforters, and Blankets): You may return your bedding purchase within 30 days of receiving the product. Bedding must be returned in the original Nest Bedding packaging. Once approved for a return, we'll supply you with return instructions.

Dog Beds: You may return your Nest Bedding Dog Bed within 30 days of the delivery date of that product. Dog Beds must be returned unused/unlaundered and in the original Nest Bedding packaging. Once approved for return, we will provide a free shipping return label.

Furniture Returns: All furniture/foundations/adjustable bases are not eligible for return once received.

*Once we've confirmed the cancellation of your order and verified that all goods have been returned to us, we'll process a refund to your purchase method. Please allow 5 to 10 business days for the funds to process fully back to your account.


EXCHANGES

Mattress Comfort Exchange Policy: Subject to the stipulations herein, Nest Bedding offers a Comfort Exchange for mattresses within a year (365 days) of delivery, following an obligatory 30-day adjustment period. The scope of this policy is limited to a single exchange per mattress, and the 365-night trial period remains unaffected by any exchange. If the purchased mattress possesses a zippered layer, the exchange is complimentary, but shipping costs, where applicable, are non-refundable. Exchanges will be declined for mattresses that are damaged or deemed destroyed.

To initiate an exchange, contact customerservice@nestbedding.com within 30 days of submitting a request. Post this 30-day period, a new request is required. Upon receipt of the exchange mattress or layer, the initial item may be returned for a full refund of its purchase price. The customer will be liable for shipping costs associated with Alaska, Hawaii, and Canada exchanges.

Exceptions to this policy include the Puffin, Lark, and Stork mattresses alongside promotional giveaway items.

Lifetime Renewal Exchange Policy: As of 10/21/2021, Nest Bedding offers a Lifetime Renewal Exchange (LRE) for the Sparrow Signature Hybrid, Owl Natural Latex Hybrid, and Finch All Latex mattresses. LRE involves the replacement of the Firm, Medium, or Soft “Plush” comfort layer within a mattress’s zippered top. This policy is applicable once per qualifying mattress purchase and cannot be transferred.  Mattresses acquired prior to October 21, 2021, do not qualify for the Lifetime Renewal Exchange policy. 


If you choose to exchange your mattress for the same or a different model within the 365-day trial period, this will count as the utilization of your Lifetime Renewal Exchange (LRE). Please note that an additional LRE will not be applied to the newly exchanged mattress, and you will not be eligible for another LRE for the exchanged mattress.

Pillows, Bedding, and Mattress Topper Exchange Policy: Pillows and bedding items may be exchanged within 30 days of delivery. Return and exchange rights are relinquished after this 30-day period. Contact customerservice@nestbedding.com or visit www.nestbedding.com or a local Nest Bedding showroom to initiate an exchange. Following the purchase of an exchange item, a return label for the original item can be requested. Refunds will be processed to the original payment method upon receipt and inspection of the returned item.

Furniture. All furniture/foundations/adjustable bases are not eligible for exchange.

 

WARRANTY

Nest Bedding ("we," "us") is committed to ensuring that you are satisfied with your purchase. We offer a limited lifetime warranty ("Limited Warranty") to original purchasers ("you") of our mattresses. Should your Nest Bedding mattress exhibit qualifying defects, we will either repair or replace it with a comparable model and size, keeping in line with the high standards of our brand. Please note warranty replacements do not extend or restart the mattress trial period.

 

NEST BEDDING WARRANTY ELIGIBILITY

This Limited Warranty is exclusively for original purchasers who have bought their Nest Bedding mattress directly from our stores, online platforms, or authorized retailers. The Limited Warranty is not transferable to subsequent owners of the mattress.

 

MATTRESS WARRANTY COVERAGE

Your Nest Bedding mattress is a product of meticulous craftsmanship and quality materials. This warranty covers the following defects under normal use, excluding conditions listed in the "What Voids The Warranty" section:

Indentations:

  • Quilted Mattresses (e.g., Sparrow, Owl, Finch, Raven, Lark, Puffin): A visible indentation or sag greater than one and a half (1 1/2) inches not attributable to improper use, inadequate foundation, or damage from flexing or bowed slats.
  • Smooth Top Mattresses (e.g., Starling, Quail): A visible indentation or sag greater than three-quarters (3/4) of an inch not attributable to improper use, inadequate foundation, or damage from flexing or bowed slats.

 

Flaws in the Mattress Cover:

  • Manufacturing flaws in the zipper, excluding zipper breakage due to overuse.
  • Physical flaws in the cover construction, such as fabric tearing or stitch unraveling.

 

WHAT VOIDS THE MATTRESS WARRANTY

The following conditions will void this warranty:

  • Unauthorized Resale: Warranty is void if the product is purchased from unauthorized dealers or third-party websites.
  • Improper Use: The primary purpose of your mattress is for sleeping, resting, and laying. Any use outside of this primary purpose is considered misuse.
  • Stains and Damages: Stains, including but not limited to body oils, sweat, and other liquids, can degrade materials and compromise the integrity of the mattress. Rips, tears, burns, and other physical damage will also void the warranty. Not expanding the mattress within 30 days of receiving further voids the warranty.
  • Improper Foundation: Using the mattress with old box springs (5+ years) without solid support, slatted wood or metal foundations with slats more than 4″ apart, or other inadequate bases will void the warranty.
  • Storage & Handling: Deformations in the mattress due to improper storage or handling.
  • Other Exclusions: Normal wear and tear, slight cosmetic flaws, growth of mold due to improper storage, indents less than one (1) inch, personal preferences about mattress attributes, mattresses acquired, used, resold, or not in possession of the original owner, purchases from non-authorized Nest Bedding distributors, physical damage by the owner, allergies to fabrics or materials, and damage from animals, rodents, or children.

 

TOP OF BED PRODUCT WARRANTY

All Nest Bedding pillows and mattress toppers have a two-year warranty. All comforters, sheet sets, duvets, and protectors have a one-year warranty. 

 

BEDDING WARRANTY

Nest Bedding ("we," "us") is committed to ensuring that you are satisfied with your purchase. We offer a 2-year limited warranty to original purchasers ("you") for our Nest Bedding pillows and a 1-year limited warranty to original purchasers ("you") of our bedding. Should your Nest Bedding Top-of-Bed item defect, we will either repair or replace it with a comparable model and size, keeping in line with the high standards of our brand. Please note warranty replacements do not extend or restart your bedding sleep trial period.

 

TOP OF BED  WARRANTY COVERAGE

Your Nest Bedding TOP OF BED item is a product of meticulous craftsmanship and quality materials. This warranty covers the following defects under normal use, excluding conditions listed in the "What Voids The Warranty" section:

Sheets, Duvets, and mattress protectors 1-Year Warranty

  • Material Defects: Warranty covers any defects in the material, such as fraying under normal use.
  • Workmanship: Covers issues related to stitching, seams, and finishing.
  • Color Fastness: Warranty against significant color fading when washing guidelines are followed.
  • Elastic and Button Integrity: Coverage for the elastic band in fitted sheets and protectors maintaining its stretch. Buttons in Duvet covers falling off. 

Mattress Toppers 2-Year Warranty

  • Structural Integrity: Covers sagging or indentation greater than 1 inch.
  • Foam Deterioration: Covers excessive crumbling or disintegration.
  • Cover Zippers: Warranty for malfunctioning zippers.
  • Elastic Integrity: Coverage for the elastic band on corners maintaining its stretch.

Pillows 2-Year Warranty 

  • Zipper Defects: Warranty against defects of zipper malfunctioning and tearing. 
  • Fill Material: Covers any issues related to the quality and performance of the fill material.
  • Stitching and Seams: Warranty for any stitching or seam issues.

Comforters

  • Fill Distribution: Covers clumping or uneven distribution of fill material.
  • Material Defects: Warranty against defects like tearing or fraying under normal use.
  • Stitching and Seams: Covers issues related to stitching and seams.

 

WHAT VOIDS THE WARRANTY 

Unauthorized Resale: Warranty is void if the product is purchased from unauthorized dealers or third-party websites.

Improper Use: Using the products in a manner other than intended (e.g., using sheets as curtains).

Lack of Proper Care: Failure to follow care instructions, including washing guidelines and maintenance.

Alterations: Any alterations or modifications to the product, such as cutting, sewing, or adding substances.

Commercial Use: Using the products in a commercial setting, such as hotels or rentals, unless explicitly stated otherwise.

Staining: Any type of staining, including but not limited to food, beverages, ink, or bodily fluids, will void the warranty.

SHEET SETS

  • Chemical Damage: Unadvised use of harsh chemicals, bleach, or solvents that result in material degradation.
  • Overheating: Use of excessively high heat during washing or drying.
  • Staining: The presence of unremovable stains that affect the functionality or aesthetics of the sheets.

TOPPERS

  • Mechanical Damage: Use of electric blankets or heating pads that result in material degradation.
  • Excessive Weight: Use exceeding the recommended weight capacity leads to sagging or indentation.
  • Staining: Any stains that cannot be removed and compromise the integrity or appearance of the topper.

PILLOWS 

  • Water Damage: Submerging the pillow in water or using it in a humid environment that leads to mold or mildew.
  • Chemical Exposure: Use of cleaning agents not recommended by Nest Bedding.
  • Staining: The presence of unremovable stains that affect the functionality or aesthetics of the pillow.

COMFORTERS

  • Chemical Damage: Use of harsh cleaning agents that result in material degradation.
  • Mechanical Damage: Rips or tears caused by pets, misuse, or accidents.
  • Staining: Any stains that cannot be removed and compromise the integrity or appearance of the comforter.

FURNITURE WARRANTY COVERAGE

All Nest Bedding furniture has a 5-year warranty coverage. 

 

FURNITURE  WARRANTY

Nest Bedding ("we," "us") is committed to ensuring that you are satisfied with your purchase. We offer a 5-year limited warranty to original purchasers ("you")   for our Nest Bedding furniture. Should your Nest Bedding furniture display a defect, we will either repair or replace it with a comparable model and size, keeping in line with the high standards of our brand. 

 

This warranty covers the following defects under normal use, excluding conditions listed in the "What Voids The Warranty" section:

FURNITURE WARRANTY COVERAGE

This 5-year Limited Warranty applies to all Nest Bedding furniture items, including bed frames, platforms, adjustable foundations, and other similar goods. The warranty is valid from the date of purchase and is non-transferable.

 

What is Covered

  • Structural Integrity: Warranty covers any defects in the structural components, such as the frame and joints, that result in instability or breakage under normal use.
  • Material Defects: Covers defects in materials, such as wood splitting, metal bending, or other deformities that occur under normal use.
  • Workmanship: Warranty against poor workmanship, including but not limited to issues related to stitching, seams, and finishing.
  • Hardware: Covers defects or malfunctions in hardware elements like screws, bolts, and fasteners.
  • Upholstery: Warranty against defects in upholstery material, such as tearing, fraying, or unraveling, under normal use.

What is Not Covered

  • Normal Wear and Tear: This warranty does not cover normal wear and tear, including but not limited to scratches, dents, and cosmetic damage from use.
  • Unauthorized Modifications: Any alterations or modifications to the furniture will void the warranty.
  • Improper Use: Using the furniture for purposes other than intended will void the warranty.
  • Commercial Use: This warranty does not cover products used in a commercial setting unless explicitly stated otherwise.
  • Staining: Any type of staining, including but not limited to food, beverages, ink, or bodily fluids, that occurs due to misuse or neglect will void the warranty.

 

MAKING A WARRANTY CLAIM

For warranty claims, contact us at customerservice@nestbedding.com. Provide the following:

  • Order number or the name of the person who placed the order
  • Description of the issue
  • Supporting photographs or videos
  • Claims will be processed within 7 business days of receipt.

 

YOUR WARRANTY REMEDY

In cases where we determine a legitimate defect exists as per this Limited Warranty, your sole remedy will be the repair or replacement of your mattress with a comparable model and size. Discontinued models will be replaced with the closest comparable product at our discretion.

 

AFFILIATE COMMISSION

Disclosure: We are a website that may receive a commission when you dispose of your mattress, foundation, or furniture through an affiliate link on our website, order confirmation page, or order confirmation email.

Neither we nor any of our subsidiaries, divisions, affiliates, agents, representatives, or licensors shall be liable to you or anyone else for any loss or injury or any direct, indirect, incidental, consequential, special, punitive, or similar damages arising out of your access or use of, or your inability to access or use, the Website or any materials, opinions, or recommendations of third parties on the Websites. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
